1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Atsrc Technologies Private Limited, a company incorporated under the Companies Act, 2013 of India, with its registered office in India ("Company," "we," "us," or "our"), governing your access to and use of the KnowingLives website, mobile applications, and related services (collectively, the "Platform").

By registering, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Platform. By using the Platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization.

3. Description of Service

KnowingLives is an online platform that connects users with advisors for consultations, including chat and voice call sessions, in areas such as wellness, astrology, and lifestyle guidance. The Platform facilitates (i) discovery and booking of advisors, (ii) in-app chat and voice calls, (iii) wallet-based payments for sessions, and (iv) related support and content. All consultations are for general guidance and entertainment only and do not constitute medical, legal, financial, or other professional advice (see Disclaimer).

4. Account Registration and Security

You must create an account to use certain features. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use. We are not liable for losses arising from unauthorized use of your account.

5. Payments, Wallet, and Billing

• Currency and pricing: Prices are displayed in Indian Rupees (INR) or other supported currencies. All amounts are inclusive of applicable taxes unless stated otherwise.
• Wallet: You may add funds to your in-platform wallet to pay for chat and call sessions. Wallet balance is non-transferable and has no cash redemption value except as required by law.
• Payment processing: Payments are processed by Stripe (or other designated payment processors). By paying, you also agree to the payment processor's terms. We do not store full card details.
• Charges: Session charges are deducted from your wallet (or charged to your payment method if applicable) based on usage (e.g., per minute or per session). You authorize us to charge the applicable amounts.
• Refunds: Refunds are governed by our Refund Policy. Disputes may be raised through your account or support; chargebacks may result in account suspension.

6. User Conduct and Prohibited Uses

You agree not to: (a) violate any applicable law or regulation; (b) infringe any third-party rights; (c) use the Platform for fraud or unauthorized transactions; (d) harass, abuse, or harm advisors or other users; (e) transmit malware or attempt to gain unauthorized access to our or others' systems; (f) scrape, reverse-engineer, or build a competitive product using the Platform; (g) use the Platform for any illegal or prohibited purpose. We may suspend or terminate accounts for breach and report conduct to authorities where required.

7. Intellectual Property

The Platform, including its design, text, graphics, logos, and software, is owned by or licensed to Atsrc Technologies Private Limited and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. You retain ownership of content you submit; you grant us a non-exclusive, royalty-free, worldwide license to use, display, and process such content to operate the Platform.

8. Disclaimers

THE PLATFORM AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ADVISOR CONTENT AND CONSULTATIONS ARE FOR GENERAL GUIDANCE ONLY AND DO NOT CONSTITUTE MEDICAL, LEGAL, OR FINANCIAL ADVICE. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Atsrc Technologies Private Limited AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED INDIAN RUPEES (INR 100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Jurisdiction-Specific Provisions

10.1 India

These Terms are subject to the laws of India. The courts at the place of our registered office shall have exclusive jurisdiction. You may have rights under the Consumer Protection Act, 2019 and rules thereunder; nothing in these Terms limits such statutory rights. For the purpose of the Information Technology Act, 2000 and rules, the name and contact of the grievance officer may be published on the Platform or provided on request.

10.2 United States

If you are in the United States, you may have additional rights under state consumer protection laws. Any dispute may be resolved by binding arbitration in accordance with the rules of a recognized arbitration body, and you waive the right to participate in class actions to the extent permitted by law. The Federal Arbitration Act and applicable state law govern.

10.3 European Union / European Economic Area / United Kingdom

If you are a consumer in the EU, EEA, or UK, you benefit from mandatory consumer rights under applicable law (e.g., Consumer Rights Directive). Nothing in these Terms affects those rights. You may bring proceedings in the courts of your country of residence. We may bring proceedings against you only in the courts of your country of residence.

11. Termination

We may suspend or terminate your access to the Platform at any time for breach of these Terms or for any other reason with notice where practicable. You may close your account at any time via account settings or by contacting support. Upon termination, your right to use the Platform ceases; provisions that by their nature should survive (e.g., disclaimers, limitation of liability, dispute resolution) will remain in effect.

12. General

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Atsrc Technologies Private Limited regarding the Platform. Our failure to enforce any right does not waive that right. If any provision is held invalid, the remainder remains in effect. We may assign our rights and obligations; you may not assign without our consent. Notices may be sent to the contact details published on the Platform or to your registered email.
